1. Acceptance of these Terms

These Terms of Service ("Terms") govern your use of InCharacter (the "App"), operated by Newdawn ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you don't agree, don't use the App.

2. Eligibility

You must be at least 13 years old to use InCharacter. If you are under the age of legal majority where you live, you may only use the App with the involvement and consent of a parent or legal guardian. By using the App, you represent that you meet this requirement.

3. What InCharacter is

InCharacter generates fictional characters, dialogue, and stories using artificial intelligence. Everything a character "says" or a story narrates is AI-generated fiction — it is not fact, not real, and not advice of any kind (medical, legal, financial, psychological, or otherwise). AI-generated content can be inaccurate, inconsistent, or nonsensical, and you should not rely on it for real-world decisions.

Characters in the App are fictional. You may not use the App to impersonate a real, identifiable person (living or deceased) without their consent, and any resemblance between an AI-generated character and a real person is not intended to depict that person's actual views, statements, or conduct.

4. User-created content & community rules

InCharacter lets you create your own characters and stories and, if you choose, publish them for other users to play. When you create or publish content, you agree not to submit content that contains:

• Explicit sexual content;
• Hate speech, harassment, or content that attacks people based on a protected characteristic;
• Graphic violence or gore;
• Content that promotes or glorifies self-harm or suicide; or
• Any other content that is illegal or that infringes someone else's rights.

Published stories pass through an automated content check before they go live, and we also rely on user reports to catch content that check misses — moderation is therefore a mix of automated screening and reactive review, not exhaustive pre-approval of every word. We may remove any content, at any time and without notice, that we determine violates these rules, and we may restrict, suspend, or terminate accounts that repeatedly or seriously violate them. 5. Subscriptions & purchases

InCharacter offers optional auto-renewing subscriptions and/or in-app purchases, billed and managed through the Apple App Store or Google Play, depending on your device. By subscribing, you agree to that store's billing terms.

• Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current period.
• You can view, change, or cancel your subscription in your Apple ID or Google Play account settings — not inside the App.
• We do not process payments or issue refunds ourselves. All billing, refunds, and payment disputes are handled by Apple or Google under their own policies.

6. Accounts & your data

InCharacter does not require you to sign up with an email or phone number. Instead, your account is tied to a random identifier generated on your device. Because there is no separate login, deleting the App deletes the local data stored on your device, including your on-device chat history — we cannot restore it for you. Content you've published to the community (see §4) may continue to exist separately, since it lives on our servers rather than your device.

7. Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated content will be accurate, appropriate, or to your liking.

8. Limitation of liability

To the maximum extent permitted by law, Newdawn will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App, even if we've been advised of the possibility of such damages. Our total liability for any claim relating to the App will not exceed the amount you paid us, if any, in the 12 months before the claim arose.

9. Governing law

These Terms are governed by the laws of [governing law / jurisdiction to be finalized], without regard to conflict-of-law principles. This placeholder will be replaced with a specific jurisdiction before public launch.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date above. Continuing to use the App after changes take effect means you accept the updated Terms.
